1. Acceptance of Terms
By engaging Evolve Mt Vernon Concrete for concrete construction services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you (the "Client") and Evolve Mt Vernon Concrete (the "Company"). If you do not agree to these terms, please do not engage our services.
2. Services Provided
The Company provides professional concrete construction services including but not limited to driveway installation and repair, patio construction, foundation work, stamped concrete, concrete repair, and commercial flatwork. All services are performed in accordance with industry standards and local building codes.
3. Estimates and Pricing
All estimates provided are based on site conditions as observed at the time of inspection. Final pricing may vary if unforeseen conditions are discovered during project execution. The Company will notify the Client of any significant price changes before proceeding with additional work. Estimates are valid for 30 days from the date of issue.
4. Payment Terms
Payment terms will be specified in the project contract. Typical payment schedules include a deposit upon contract signing, progress payments at specified milestones, and final payment upon project completion. The Company reserves the right to suspend work if payments are not received according to the agreed schedule. Late payments may incur additional fees.
5. Project Timeline
The Company will provide estimated project timelines based on project scope and current scheduling. While we strive to meet all deadlines, timelines may be affected by weather conditions, material availability, permit delays, or unforeseen site conditions. The Company is not liable for delays caused by circumstances beyond our reasonable control.
6. Client Responsibilities
The Client is responsible for providing accurate property information, obtaining necessary permissions from homeowners associations or landlords, ensuring access to the work site, protecting personal property, and maintaining clear communication throughout the project. The Client must also ensure that all utilities are properly marked before excavation begins.
7. Permits and Inspections
The Company will obtain necessary building permits when required and coordinate required inspections. Permit fees are typically included in project pricing unless otherwise specified. The Client is responsible for providing access for inspectors and addressing any violations or corrections required by building officials.
8. Warranty
The Company warrants that all work will be performed in a professional manner using quality materials. Specific warranty terms will be provided in the project contract. Warranties do not cover damage caused by improper maintenance, abuse, acts of nature, or modifications made by others. Warranty claims must be submitted in writing within the warranty period.
9. Limitation of Liability
The Company's liability is limited to the contract price of the services provided. The Company is not liable for indirect, incidental, or consequential damages. The Company maintains appropriate insurance coverage and will address any damage to property caused by our work during the project execution.
10. Changes and Modifications
Any changes to the project scope, specifications, or timeline must be agreed upon in writing by both parties. Change orders may affect project pricing and completion dates. The Company reserves the right to refuse change requests that compromise structural integrity or violate building codes.
11. Cancellation Policy
Either party may cancel the contract with written notice. Cancellation by the Client after work has commenced may result in charges for work completed, materials purchased, and scheduling disruption. Deposits may be non-refundable depending on project stage and expenses incurred.
12. Dispute Resolution
Any disputes arising from these terms or the services provided will first be addressed through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the laws of the Commonwealth of Virginia. The prevailing party may be entitled to recover reasonable attorney fees.
13. Governing Law
These Terms of Service are governed by the laws of the Commonwealth of Virginia. Any legal proceedings must be brought in the appropriate courts of Virginia.
